What are the factory Act 1934 and provisions relating to child workers and women workers

ADULT WORKING HOURS :-
Following working hours are given by law :

1. Daily Working Hours :-
In a factory one worker may be required to work for not more than 9 hours a day. In a seasonal factory a male adult worker may work for ten hours.

2. Weekly Working Hours :-
In a week a worker is required to work 48 hours a week. In a seasonal factory a worker is not allowed to work more than 50 hours. In case of technical reason a worker may be allowed to work for 60 hours in a week.

3. Work In Two Factories :-
In the same day a worker is not allowed to work in two factories except under special circumstances.

4. Over Time :-
If any worker has worked 9 hours in a day or more than 48 hours in a week in a non seasonal factory, he has a right to be paid over time at the double rate.


CHILD WORKERS :-

1. Working Hours :-
In a factory child is not allowed to work more than a 5 hours in one day. The time period during which a child is allowed that is from 6 a.m. to 7 p.m.

2. Fitness Certificate :-
A person below than 17 years cannot be allowed to work in a factory without obtaining the certificate of fitness from the certifying surgeon.

3. Register Of Child Worker :-
The manager of the factory will maintain the separate register for the child workers. Particulars like, name, age, group, nature of work and fitness certificate will be shown in the register.

4. Work On Dangerous Machine :-
A worker below than 17 years is not allowed to work on dangerous machine.

5. Machine In Motion :-
When machine is in motion, a worker below than 17 years is not allowed to clean it or oil it.

6. Cotton Opner :-
It is very harmful for the child health to work at the place where cotton opner is working. A person below than 17 years is not allowed to work these.

7. Double Duty :-
A worker below than 17 years is also not allowed to perform double duty because it is also harmful for health.


WOMEN WORKER :-

1. Working Time :-
According to act, a women shall be allowed to work between 6 a.m. to 7 a.m but provincial govt. may allow the women to work between 5 a.m. to 7 p.m. in some case.

2. Working Hours :-
A women is not allowed to work more than 9 hours in a day. In this regard no exemption is allowed.

3. Suitable Room :-
If any factory more than 50 women are working, one suitable room should be provided to the for then use of children's under six year.

4. Machinery In Motion :-
A women is not allowed to clean or adjust any part of the machinery which is in motion. She is not allowed to work between the moving parts of the machinery.

5. Cotton Opners :-
A women is not allowed to work for pressing cotton at the place where cotton opner is working.

HOLIDAYS WITH PAY :-

1. Casual Leave :-
Ten days casual leaves are allowed with full pay to the worker in a one year.

2. Sick Leave :-
In this case 16 days leave on 1/2 average pay is allowed to each worker in a one year.

3. Festival Holidays :-
All those holidays which are declared by the govt. will be entitled to the each worker with full pay.

4. Annual Holidays :-
In this case, 14 days consecutive holidays with full pay are allowed to every worker if he has completed 12 months continuous service in a factory. If he fails to avail such holidays, these can be en-cashed or those back can be carry forward to next year.
